The Kerala Municipality Honorarium & Allowances to Representatives of people) Rules, 1995

1 Short title and commencement.—

(1) These rules may be called the Kerala Municipality (1[Honorarium & Allowances] to Representatives of people) Rules, 1995,

(2) They shall be deemed to have come into force on the 1st day of October, 1995.

 

2. Interpretation.— Unless the context otherwise requires, the words and phrases used in these rules and defined in the Kerala Municipality Act, 1994 (20 of 1994) shall have the meanings respectively assigned to them in that Act.

 

3. 2[Monthly Honorarium] to Chairperson, Deputy Chairperson and Councillors.— The Chairperson, Deputy Chairperson and Councillors of a Municipality shall be paid 2[monthly honorarium] at the rates specified below:-

(1) In the case of a Town Panchayat or a Municipal Councill,-

    1.  3[Four Thousand rupees] to the Chairman;
    2.  4[Thrcc Thousand Rupees] to the Deputy Chairman;
    3.  5[One thousand Seven hundred and fifty rupees] each to the Chairman of Standing Committee;
    4.  ''[One thousand Two hundred and fifty rupees] each to Councillors.

(2) In the case of Municipal Corporation,-

    1.  7[Four Thousand and Five Hundred Rupees] to Mayor;
    2.  "(Three Thousand and five Hundred Rupees] to Deputy Mayor;
    3.  9[Two Thousand Rupees] each to Chairman of Standing Committees;
    4.  10[One Thousand and Five Hundred Rupees] each to Councillors. 13[x x x x]

4. Travelling Allowance to attend Meetings.— The Chairperson, Deputy Chairperson, Standing Committee Chairman and Councillors shall be paid travelling allowance at the rates specified below for participating in the meeting of the Council of a Municipality or any of its committees, but the daily allowance shall not be paid alongwith such travelling allowance, namely:-

(i) at the rates eligible to Class 1 Officers of the Government as per the Kerala Service Rules for the time being in force, to the Chairperson, Deputy Chairperson and Standing Committee Chairman;

(ii) -at the rates eligible to Class II (a) Officers of the Government as per the Kerala Service Rules for the time being in force, to each Councillor.

5. Sitting fee for Attending the Meeting.— The sitting fee that may be sanctioned to the Chairperson , the Deputy Chairperson, the Standing Committee Chairman and Councillors of a Municipality for attending the meetings of the Municipal Council or any of its committees shall be at the rates specified below, namely:-

(i) rupees forty per day to the Chairperson, Deputy Chairperson, and each Standing Committee Chairman subject to the limit of rupees two hundred per mensem;

(ii) rupees thirty two per day to each Councillor subject to the limit of rupees one hundred and sixty per mensem.

6. Travelling Allowance and Daily Allowance.— (1) The Chairperson and the Deputy Chairperson of a Municipality shall while on a tour in connection with public purpose, be eligible for travelling allowance and daily allowance at the rates applicable to Class I Officers of the Government in accordance with the provisions of the Kerala Service Rules, for the time being in force.

(2) The Standing Committee Chairman of a Municipality shall, while on a tour in connection with public purpose, be eligible for travelling allowance at the rates applicable to Class I Officers of the Government in accordance with provisions of the Kerala Service Rules for the time being in force.

(3) Each Councillor of a Municipality, shall, for the following journeys be eligible for travelling allowance and daily allowance at the rates applicable to Class II (a) Officers of the Government in accordance with the provisions of the Kerala Service Rules for the time being in force—

(a) journeys made to the District Headquarters or Taluk Headquarters for the purposes of Municipality with the consent of Municipal Council; or

(b) journeys made, on invitation, to participate in the meetings or in the training programmes convened by the Government or officers authorised by them; or

(c) journeys made for matters, approved by resolution by majority of Councillors present in the meeting, related to the Municipality but not included under clause (a) and clause (b).

7. Contexts where Travelling Allowance and Daily Allowance are not admissible.— Travelling Allowances and Daily Allowances are not admissible for journeys performed to and from a place within eight kilometers of the headquarters of the Municipality or without approved of the concerned Municipal Council or by the Chairperson or the Deputy Chairperson or the Councillor outside the State without the prior sanction of the Government.

8. Scrutiny of Travelling Allowance Bills.— The amount of the Travelling Allowance to a Councillor, Standing Committee Chairman and Deputy Chairperson shall be paid only after the bill has been scrutinised and passed by the Chairperson as per these rules.

Explanatory Note

(This does not form part of the Notification , but is intended to indicate its general purpose.)

As per Section 13 of the Kerala Municipality Act, 1994 (20 of 1994) Government have to prescribe the allowances to be paid to the Councillors, Deputy Chairperson and Chairperson of a Municipal Council and the travelling and daily allowances to be paid for journeys performed by them for public purposes. The rates of travelling and daily allowances have also to be prescribed. Government have, therefore, decided to fix the allowances to be paid to the Chairperson, Deputy Chairperson and Councillors of a Municipality and to fix the rates of travelling allowances and daily allowances of Chairperson, Deputy Chairperson, Chairman of Standing Committees as that payable to Class I Officers of Government Service and that of Councillor as that payable to Class II (A) Officers of Government as per Kerala Service Rules as in force. This Notification is intended to achieve the above purpose.
