The Kerala Municipality (Registration of Private Hospitals and Private Paramedical Institutions) Rules, 1997

S.R.O.No. 700/97.— In exercise of the powers conferred under section 313 of the Kerala Municipality Act, 1994 (20 of 1994) read with section 565 thereof, the Government of Kerala, hereby make the following rules, namely :-RULES

1. Short title and commencement.—

(1) These rules may be called the Kerala Municipality (Registration of Private Hospitals and Private Paramedical Institutions) Rules, 1997.

(2) They shall come into force at once.

2. Definitions.— In these rules, unless the context otherwise requires,-

(a) 'Act' means the Kerala Municipality Act, 1994 (20 of 1994);

(b) 'Form' means form appended to these rules;

(c) 'Register' means a register in Form No. 2 kept for recording the particulars regarding Private Hospitals and Paramedical Institutions registered in the Municipality;

(d) 'Section' means a section of the Act;

(e) Words and expressions used and not defined in these rules, but defined in the act shall have the meanings respectively assigned to them in the Act.

3. Registration of Private Hospital and Private Paramedical Institutions.—(1) No private hospital and private paramedical institutions shall be established within the territorial limits of a Municipality without previous registration under these rules.

(2) a person who proposes or is authorised to establish a private hospital or a paramedical institution shall submit the application for registration to the Secretary in Form No. 1 together with the registration fee of Rupees three hundred at fifteen days before the starting of such institution and the Secretary shall reject forthwith an application not accompanied with such fee.

(3) The Secretary or an officer authorised by him shall, within one week from the date of receipt of an application for registration of a private hospital or a private paramedical institution, visit the site where the institution is proposed to be established by the applicant and prepare an enquiry report in writing in the relevant part of Form No. Iregarding the cleanliness of the site, safety of the building or buildings and correctness of the other informations furnished in the application.

(4) The Secretary shall, after considering the details in the application and the enquiry report, decide whether the registration is to be granted or not:

Provided that the Secretary shall, if decides to reject the application, serve a notice on the applicant stating the reasons for the same and take a final decision after examining the submission, if any, made within the time specified in the said notice.

(5) The applicant may file an appeal before the Council against any decision taken under sub-rule (4) within thirty days of receipt of the order.

(6) The Secretary shall, if decides to grant registration record the particulars regarding the institution in a separate register in Form No. 2 and on such recording the institution shall be deemed to have been registered.

(7) The Secretary shall issue a certificate in Form No.3 to the applicant as an evidence ofthe private hospital or private paramedical institution having registered in the Municipality.

(8) A person running any private hospital or private paramedical institution shall, exhibit the registration certificate in the concerned institution itself and shall produce the same for inspection as and when required by the Secretary or an officer authorised by him.

(9) If the registration certificate of a private hospital or a private paramedical institution is lost, the person running it shall apply for a duplicate certificate together with a fee of fifty rupees and the Secretary shall, on receipt of such application, issue a duplicate of the registration certificate.

(10) The validity of registration of a private hospital or a private paramedical institution in a Municipality shall be till the end of that financial year.

(11) The person running a private hospital or a private para medical institution shall inform the Secretary in writing, the details of the change in name, address or closure of the same, within fifteen days of its occurrence and the Secretary shall, on receipt of such information, as the case may be make necessary changes in the register and the registration certificate or cancel the registration certificate.

4. Registration of the existing private hospitals and private paramedical institutions.— (1) A person running any private hospital or a private paramedical institution, which was in existence at the time of commencement of the Act and is still functioning or which has started functioning after the commencement of the Act and has not been registered, shall, within a period of three months from the date of commencement of these rules, submit an application for registration in accordance with these rules.

(2) An application for registration of a private hospital or a private paramedical institution in a Municipality under sub-rule(l) shall be submitted to the Secretary in Form No. 4 together with a registration fee of Rupees three hundred.

(3) The Secretary shall, on receipt of an application under sub-rule(2) conduct on enquiry and if satisfied with the correctness of the particulars in the application, give registration observing the procedures laid down in sub-rules (6) and (7) of rules 3.

5. Renewal of registration.—The registration of a private hospital or a private paramedical institution in a Municipality shall be renewed before the commencement of the next financial year and an application for such renewal shall be made in Form No. 5 together with a renewal fee of Rupees one hundred.

(2) The Secretary shall, in case the registration is renewed under sub-rule (1), enter theparticulars regarding the same in the register in Form No. 2 and issue a registration certificate in Form No. 3.

6. Cancellation of registration.— (1) The Secretary shall, if any person running a private hospital or private paramedical institution, violates any of the conditions in the registration certificate, after giving him an opportunity for making representation, cancel the registration certificate and remove the name of the institution from the register.

(2) A person running that institution may file an appeal before the Council against the decision of the Secretary under sub-rule (1), within thirty days of receipt of the order,

Explanatory Note

(This does not form part of the Notification, but is intended to indicate its general purpose.)

Section 313 of the Kerala Municipality Act, 1994 (20 of 1994) empowers the Government to make rules regarding the details to be included in the form for registration or renewal of registration of a private hospital or paramedical institution. Government have decided to make rules accordingly. Hence this Notification.
