The Kerala Municipality (Publication of notice against the Burial of Corpse) Rules, 2000.

1. Short title and commencement.-

(1) These rules may be called the Kerala Municipality (Publication of notice against the Burial of Corpse) Rules, 2000.

(2) They shall come into force at once.

2. Definitions.-

(1) In these rules, unless the context otherwise requires,-

 (a) "Act" means the Kerala Municipality Act, 1994 (20 of 1994);

 (b) "Section" means a section of the Act;

 (c) "Secretary" means the Secretary of a Municipality.

(2) Words and expressions used but not defined in these rules, but defined in the Act shall have the meanings respectively assigned to them in the Act

 

3. Publication of the notice that no corpse shall be buried.-The Secretary shall publish the notice under clause (b) of sub-section (1) of section 488 informing that it is unlawful to bury, burn or otherwise dispose of any corpse in any burial or burning ground, in the Government Gazette, in the notice board of the office of the Municipality, in a conspicuous place in the premises of such prohibited burial or burning ground and in the dailies having wide circulation in the Municipal area, and shall also inform, in writing, the owner or occupier of such burial or burning ground. The fact regarding the notice may also be broadcast through the media such as Radio, Television etc.

 

Explanatory Note

(This does not form part of the Notification, but is intended to indicate its general purport.) In sub-section (1) of Section 488 of the Kerala Municipality Act, 1994 (20 of 1994), the procedure for the prohibition of the use of burial and burning grounds which are harmful to health or overcrowded with graves and in sub-section (2) the empowerment of the Government in respect of publication of the notice under clause (b) of sub-section (1) in the Gazette and in such other manner as may be prescribed, are dealt with. Government have decided to make rules for the publication of such notice, accordingly. This Notification is intended to achieve this object.
